Morph Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Morph mobile application and related services (the "App" or "Service"), operated by Shiv Patel ("Morph," "we," "our," or "us"). Please read them carefully. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Acceptance of These Terms
By creating an account or using the App, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy, which is incorporated here by reference. Your continued use of the App means you accept any updated version of these Terms as described in Section 16.
2. Eligibility
You must be at least 18 years old to use the App and to purchase a subscription. If you are between 13 and 18, you may use the App only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. The App is not intended for anyone under 13, and we do not knowingly allow use by children under 13.
3. The Service
Morph is a hair health tracking app. It uses your device's camera to capture photos of your scalp and hair, applies AI analysis to generate a Hair Health Score and related metrics, produces a personalized routine, and lets you track changes over time. We may add, change, suspend, or discontinue any part of the Service at any time without notice.
4. Medical Disclaimer
Morph is not a medical device and does not provide medical advice, diagnosis, or treatment. The Hair Health Score, Norwood stage estimates, routines, and all other outputs are informational and observational only. They are estimates generated by software and are not a substitute for professional advice from a qualified doctor, dermatologist, or trichologist.
Always seek the advice of a qualified health provider with any questions about a medical condition, including hair loss, and never disregard or delay seeking professional advice because of something you saw in the App. If you think you may have a medical condition, contact a healthcare professional. Do not start, stop, or change any treatment based solely on the App.
5. No Guarantee of Results
Hair health depends on many factors outside our control, including genetics, health, and consistency. We make no promise, representation, or guarantee about any specific outcome, including any improvement in your Hair Health Score or the regrowth, thickening, or retention of hair. Any examples, transformations, or results shown in the App or in our marketing are illustrative and are not a promise of the results you will achieve.
6. AI and Scan Limitations
The App relies on AI models to interpret your photos. These outputs are automated estimates and may be inaccurate, incomplete, or inconsistent, and may vary between scans even under similar conditions. Photo quality, lighting, and angle affect results. You should treat all scores and recommendations as approximate guidance rather than fact. We do not use your scan photos to train or improve AI models.
7. Subscriptions, Billing, and Free Trials
Some features of the App require a paid subscription. Subscriptions are sold and billed through your Apple App Store account using Apple's In-App Purchase system, and are managed on our side through RevenueCat.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period (for example, weekly or annually) unless you cancel at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours before the period ends.
- Cancellation. You can manage or cancel your subscription at any time in your Apple ID account settings. Cancellation takes effect at the end of the current billing period. Deleting the App does not cancel your subscription.
- Prices and changes. Prices may change. We will give notice of price changes as required, and continued use after a change takes effect means you accept the new price.
- Refunds. All purchases are processed by Apple and are subject to Apple's refund policies. We generally cannot issue refunds directly; refund requests must be made to Apple.
8. Your Content and Photos
You retain ownership of the photos and information you provide ("Your Content"). By using the App, you grant us a limited, non-exclusive license to store and process Your Content solely to operate the Service and provide your results, as described in our Privacy Policy. You represent that you have the right to submit Your Content and that it does not violate any law or the rights of others.
9. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms
- Upload photos of anyone other than yourself without their consent
- Attempt to reverse engineer, decompile, or interfere with the App or its security
- Access the Service through automated means or resell, redistribute, or exploit it commercially
10. Intellectual Property
The App, including its software, design, branding, the Hair Health Score methodology, generated routines, and all related content, is owned by Shiv Patel and protected by intellectual property laws. We grant you a personal, limited, non-transferable, revocable license to use the App for your own personal, non-commercial use. All rights not expressly granted are reserved.
11. Privacy
Your use of the App is also governed by our Privacy Policy, which explains what data we collect and how it is used. By using the App you consent to those practices.
12. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that any result or recommendation will be accurate or reliable.
13. Limitation of Liability
To the maximum extent permitted by law, Shiv Patel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of or inability to use the App. To the maximum extent permitted by law, our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.
14. Indemnification
You agree to indemnify and hold harmless Shiv Patel from any claims, damages, or expenses arising from your misuse of the App, your violation of these Terms, or your violation of any law or the rights of a third party.
15. Termination
We may suspend or terminate your access to the App at any time if you breach these Terms or if we discontinue the Service. You may stop using the App at any time. Sections that by their nature should survive termination, including Sections 4, 5, 6, 10, 12, 13, and 14, will continue to apply.
16. Changes to the Service and These Terms
We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, provide notice in the App. Your continued use of the App after changes take effect means you accept the revised Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or the App will be resolved in the courts located in Massachusetts, and you consent to their jurisdiction.
18. Apple App Store Additional Terms
These Terms are between you and Shiv Patel only, not with Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide any maintenance or support for the App. To the extent permitted by law, Apple has no warranty obligation with respect to the App, and any claims, losses, liabilities, damages, costs, or expenses attributable to a failure of the App to conform to any warranty are our responsibility, not Apple's. Apple is not responsible for addressing any claims relating to the App, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, or claims arising under consumer protection or similar law. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you. You represent that you are not located in a country subject to a US Government embargo and are not on any US Government restricted-parties list.
